A BILL to amend the Code of West Virginia, 1931, as amended, by adding thereto a new article, designated §8-5A-1, relating to creating the Taxation with Representation Act; providing for nonresidents of a municipality who work in that municipality and who pay user fees pursuant to a municipal ordinance may vote in municipal elections.

Be it enacted by the Legislature of West Virginia:


ARTICLE 5A.  Taxation With Representation Act.

§8-5A-1.  Taxation With Representation Act.


Notwithstanding any other provision of this code to the contrary, and provided that a person is not otherwise disqualified, a person who lives outside a municipality’s corporate limits and who pays a user fee or other tax imposed by that municipality pursuant to §8-13-13 of this code may vote in all elections of that municipality.

 

NOTE: The purpose of this bill is to create Taxation With Representation Act whereby nonresidents of a municipality who work in that municipality and who pay user fees pursuant to a municipal ordinance may vote in municipal elections.
